
Hi graham, there is no way you should have been suspended mate, a bit out of order most people think. So in answer to your question no I have no proof that these spats are a great danger to other road users but I wouldn't want to be on the receiving end of one should it come off when I'm overtaking a caravan on the motorway.

With so many of these spats falling off I find it hard to believe Swift have not done anything themselves to rectify the problem, they have been aware of the problem since June 2010 but have chosen to ignore it and at £160 plus fitting per side and over £300 per side for a twin axle this works out to be a very expensive repair for the caravan owner. He agreed the design and fixing of the spats was of poor design and that they were now aware of the situation regarding the spats but unfortunatly could go no further with the investigation. He also said if VOSA went ahead and took Swift to court to try and force a safety product recall Swift's defence lawyer would ask if there were any reports of anybody being involved in an accident as a result of a wheel spat coming off, at the moment with the answer being no he felt the court would throw the case out of court. He said as nobody has been injured or killed as a result of a wheel spat falling off there was nothing else VOSA could do about it. The first was the design, the second was the possible failure of the design, the third was the potential danger to other road users. He said there is three things they look at into deciding what action to take. I had a long chat on the phone yesterday with the VOSA engineer who is looking into the spats. I fixed them with self tapping screws by screwing them in vertically under the sill. I had a problem with the wheel spats on my Swift van but they just broke and flapped about without breaking off. I have since replied to VOSA asking them if they actually did and investigation themselves and raised a few other points to their letter. I believe all they did was ask Swift for a report on the spats. I had a letter from VOSA last week telling me they had looked into it with the help of SWIFT and that they could find nothing wrong with the spats. I reported the issue to VOSA a few weeks ago who said they would investigate it. This was first reported to Swift in June 2010 and up to now they have done nothing about it. The reason is they are only held in place by a small 10mm x 1mm piece of plastic on both ends, when this piece of plastic breaks the spats just fall off. Lots of people have lost them while traveling for no apparent reason they just fall off. As everybody knows there is a design fault with these wheel spats.
